The 23andMe class action lawsuit over the 2023 data breach is closed to new claims. The last day to file was February 17, 2026. The bankruptcy court approved a $46.75 million fund on July 7, 2026, but as of September 29, 2026 no payment date has been announced. Filed? You wait. Didn’t file? Nothing is left to file.
Two Deadlines, Both Passed
There were two deadlines, run by two separate processes. Meeting one didn’t cover the other.
- July 14, 2025: the bankruptcy bar date for a Cyber Security Incident proof of claim, which the Pennsylvania Attorney General urged breach victims to file.
- February 17, 2026: the class settlement claim deadline, filed with the Class Member ID from your notice.
- June 12, 2026: the last day to fix a claim flagged by Kroll Settlement Administration.
How the $30 Million Deal Became $46.75 Million
Bankruptcy replaced the first deal with a bigger one. In September 2024 the genetic testing company agreed to a $30 million settlement in San Francisco federal court. Then it filed for Chapter 11 on March 23, 2025, and the case moved to the bankruptcy court in St. Louis. A reworked deal capped at $50 million won final approval on January 30, 2026, and Judge Brian Walsh approved the final $46.75 million figure on July 7, 2026: about $32.5 million for class claims and more than $14 million for Kroll.
What the 23andMe Data Breach Settlement Pays
Your payout depends on your claim type. The class is about 6.4 million U.S. customers notified that their personal information was exposed between May 1 and October 1, 2023.

Why Checks Haven’t Arrived
Payments stay paused until the bankruptcy reconciliation finishes, and as of late July 2026 no mailing date existed. When we checked coverage in September 2026, we found no report that money had gone out. Our guide on how long class actions take explains why this last stage drags.
The $18 Million State Deal and Your Deletion Rights
The states settled separately, and none of that money goes to individuals. On July 14, 2026, a coalition including the New York Attorney General announced $18 million from the bankruptcy estate. The deal requires the buyer to keep offering customers the right to delete their information.
That buyer is TTAM Research Institute, a nonprofit led by co-founder Anne Wojcicki, which paid $305 million and closed on July 14, 2025. About 1.9 million people asked for deletion after the bankruptcy filing. You can still delete genetic data and request sample destruction under Settings in your account.
