Yes, there’s an open class action lawsuit State Farm auto policyholders can claim from right now, but only in two states. Washington drivers paid under underinsured motorist property damage coverage have until December 14, 2026 to claim an estimated $625 from an $8.8 million settlement. Louisiana drivers with a totaled car have until October 19. The homeowner cases, including the Los Angeles wildfire disputes, have no payout yet.
Two State Farm Settlements Still Taking Claims

The Louisiana case, Robin v. State Farm Mutual Automobile Insurance Co., covers sales tax, title, and registration fees missing from total loss checks. It’s small, but it pays once per totaled vehicle.
How the Washington Payout Math Works
Your share depends on your repair bill. Diminished value is the resale value a car loses after a crash, even when it’s repaired well, and the lawsuit alleged the insurer didn’t pay it on underinsured motorist claims. The vehicle had to meet all of these:
- No more than six years old, with under 90,000 miles.
- A repair estimate of at least $1,000.
- Structural (frame) damage, deformed sheet metal, or body and paint work.
Two details most summaries skip: any diminished value already paid is credited dollar for dollar, and a car with a prior accident gets 50% of the normal amount. Got $300 for diminished value back then? Expect your check to shrink by $300. The claim form asks for the class member ID from your notice, and final approval is set for October 30.
Deadlines That Already Closed This Year
A notice you got months ago may belong to one of these closed deals. Filed claims still get paid; new ones don’t.
- Missouri labor depreciation (Pregon): $25 million for structural damage claims where State Farm Fire and Casualty withheld depreciation on labor. Closed April 2.
- New Mexico uninsured motorist (Schwartz): $20.93 million, refunding up to 21% of premiums. Closed July 2.
- Alabama total loss fees: $20.50 per claim. Closed July 15.
- Arkansas total loss valuation: $15.6 million over Audatex reports, averaging about $489. Closed August 19.

Class Action Lawsuit Against State Farm Homeowners Insurance: Where It Stands
No homeowner case has a claim process yet. The main litigation is still in court or with regulators:
- LA wildfire claims: In May, the California Department of Insurance took action against State Farm General after finding 398 violations in 220 reviewed claims from the Eaton and Palisades fires. Los Angeles County sued separately on September 1. Neither is a class action.
- Non-renewal conspiracy (Ferrier): 60 homeowners allege 16 insurers coordinated to drop fire coverage before the 2025 fires. The U.S. Justice Department filed a statement of interest.
- Algorithm bias (Huskey): a proposed class action in the Northern District of Illinois claims claim-screening tools flagged Black homeowners for extra scrutiny, violating the Fair Housing Act. It’s still in discovery.
